Deutsch Kerrigan has defended every type of chemical exposure catastrophic loss, ranging from plant explosions, toxic releases from industrial plants, land fills, to oil and gas exploration sites, including individual, consolidated and class action claims. Additionally, we have defended toxic releases from trains, container trucks and totes on smaller vehicles. In some matters, our attorneys have:
- Acted as consultants to a contractor who dredged a drainage canal and sole the dirt as construction fill, relative to CERCLA liability and indemnity issues arising out of disposal of contaminated soil.
- Represented the operator of a landfill in a suit against the owner, arising from compliance with a DEQ closure order.
- Advised a succession regarding the cleanup of possibly contaminated commercial property, which was an asset of the succession.
We routinely advise our clients on environmental issues prior to litigation and strive to avoid unnecessary litigation.
