The Louisiana Second Circuit Court of Appeal unanimously affirmed the trial court’s decision to dismiss the Plaintiff’s case as abandoned. Plaintiff argued that he was prevented from taking action in the trial court during the pendency of chasing supervisory review of a partial denial of a motion for summary judgment. Jonathan Walsh argued the Plaintiff was not so prevented and had no stay in place. The Court of Appeals agreed and affirmed the judgment of the trial court, which dismissed the case as abandoned.
