Robert Kerrigan and Raymond Lewis defended R360 Environmental Solutions, an oil and gas exploration services company, in a personal injury and premises liability action in the 31st Judicial District Court of Louisiana. The plaintiff claimed that his 18-wheeler flipped on its side inside R360’s facility due to the negligence of R360’s employee and also alleged unreasonably dangerous conditions of the facility’s roadways. At trial, defenses were asserted to general liability as well as medical causation; plaintiff was claiming that the accident caused the need for him to have a future spinal surgery and rendered him permanently disabled. After a four-day jury trial, the jury concluded that plaintiff bear 60% of fault. The jury’s total damage award was $2,500 in past-medical expenses.
