Successfully defended insurance client in wrongful death claim of family members of a man and young boy. Plaintiff claimed the death of the individuals resulted out of a gyrocopter crash. Defense argued the gyrocopter based on aircraft/watercraft exclusion of the defendant’s homeowners insurance policy. Since no court had ruled a gyrocopter as an “aircraft” or on the liability from a gyrocopter no longer owned by the insured at the time of the accident, the defense analogized the aircraft matter to previous “watercraft” cases. Client was dismissed on summary judgement.
