Personal Injury - Motion for Summary Judgment
Mr. Courtenay and Mr. Moghis successfully defended a gym equipment service company in an action brought by patron injured at a local facility in Jefferson Parish. The Plaintiff alleged that his injuries were caused by a defect in a treadmill at the facility that caused him to fall, sustaining serious injuries as a result. Our client conducted bi-annual inspections of the equipment at the facility, the last of which took place nearly three months prior to Plaintiff’s accident. Mr. Courtenay and Mr. Moghis successfully argued in a Motion for Summary Judgment that our client owed no duty to the Plaintiff and could not be found responsible for failing to discover a latent defect in the machine that had performed properly every day before and following the bi-annual inspection until the date of injury. The Court ultimately agreed, dismissing the case against our client with prejudice.
