In August 2023, Josh Keller and Colin Casciato successfully argued a Motion for Summary Judgment in John Davis v. James Juneau, et. al. Suit No. 706094 (East Baton Rouge Parish – Judge Higgonbotham). Plaintiff was represented by James Williams and Ed Murray of the Chehardy, Sherman law firm. The case involved an alleged rear end accident that occurred at the intersection of Clearview and Airline in Metairie, LA. There was no police report or 911 call. The Defendant denied hitting the plaintiff’s car. The defendant claimed that he was in an accident at this location, but he struck a different vehicle. Using photos of the other vehicle from the scene, Mr. Keller tracked down the driver (a non-party to the lawsuit), and noticed her deposition. During her deposition, the other driver confirmed that she was involved in an accident with the defendant, and she did not hit any other cars. In support of the motion for summary judgment, the defense argued that plaintiff had nothing more than his own self-serving testimony to support his allegations and this was insufficient to defeat a motion for summary judgment. The trial court agreed, granted the motion for summary judgment and dismissed the defendants with prejudice.
