On September 16, 2022 Judge Anthony Thibodeaux of St. Martinville Parish granted the defense Motion for Summary Judgment and dismissed them from the case. In this case, an employee of an LLC sued the manager of the LLC after he was injured weed eating the manager’s property. The employee alleged that his claim was not barred by workers’ compensation because he was performing work at his employer’s personal residence. After deposing the Plaintiff and securing an affidavit from the insured, the defense filed a Motion for Summary Judgment arguing that Plaintiff was limited to the exclusive remedy of workers’ compensation. The trial court agreed, and the case was dismissed with prejudice at Plaintiff’s cost.
