Securities Fraud, Mary Margaret Ward, et al. v. Succession of Richard W. Freeman, et al.
Mr. Kerrigan represented the plaintiffs in this case, who were former shareholders of a Coca-Cola bottling company. The company and two of its former officers and directors were sued for fraud, breach of fiduciary duty, and securities fraud in connection with a tender offer. After a three-week jury trial in the United States District Court for the Eastern District of Louisiana, the plaintiffs obtained a judgment for $4.6 million. The Fifth Circuit reversed the judgment and remanded the case because of faulty jury instructions and attorney-client privilege issues. The case settled for the same amount before the retrial commenced.
